General Compliance Information

The General Data Protection Regulation 2016/679 is a regulation in European Union (EU) law that enacts data protection and privacy for all individuals within the European Union and the European Economic Area. It also addresses the export of personal data outside the EU and EEA areas.  Reference: https://eugdpr.org/

GDPR applies to any company (whether a controller or a processor) established in the EU that processes personal data, regardless of whether the processing takes place in the EU.  More significantly, the GDPR also applies to companies that are NOT established in the EU if they process the personal data of EU-based individuals for the purpose of:

(a) Offering them goods or services.

(b) Monitoring their behavior within the EU (e.g. social media, online tracking, data analytics).

GDPR applies to any organization that meets the above criteria, irrespective of where they are located.  StarfishETL chooses to be GDPR compliant not only for regulatory reasons, but also because it is our innate belief that GDPR is an essential guideline for customers and partners to follow.

StarfishETL is considered a processor under GDPR regulations, and therefore works to meet its compliance expectations as such.  Read more about the expectations of a controller vs. a processor here.

StarfishETL as an iPaaS

Customers shall be independently responsible for protecting their data within the context of the iPaaS agreements in order to access and use the StarfishETL system. StarfishETL does not take responsibility for this aspect of data protection since it has no independent control over such personal data.

StarfishETL shall process personal data solely on the instructions of its customers and partners, within the context of the agreements with them, in line with the purposes and means provided by such customers.

StarfishETL takes the privacy and security of individuals and their personal information seriously and takes every reasonable measure and precaution to protect and secure the personal data we process. We have robust information security policies and procedures in place to protect personal information from unauthorized access, alteration, disclosure or destruction, and have several layers of security, including:

No data is kept at rest

Data over the wire is encrypted with SSL

Password encryption using AES 256-bit encryption

Black box testing of Web services for cross-site injection and other jacking tactics

Cloud services are hosted on Amazon AWS

Black box testing of servers

Servers are currently located in Northern Virginia, United States. They are hosted by Amazon AWS - https://aws.amazon.com/about-aws/global-infrastructure/ which is a GDPR-compliant hosting agency

Customer & Partner GDPR Expectations

As a customer or partner of StarfishETL, we require your opt-in to allow us to store your information.  We have stringent processes in place regarding which information we keep, how often we communicate with you, and by what means. You can opt-out at any time, and we will comply within the regulated timeframe to facilitate your withdrawal.  This ensures that all individuals whose personal information we process are informed of why we need it, how it is used, what their rights are, who the information is disclosed to, and what safeguarding measures are in place to protect their information.Please read our Privacy Policy for more information.

Team GDPR Expectations

The entire StarfishETL team is required to take training on GDPR Compliance.  Each individual must understand the necessity of being GDPR compliant and their responsibilities in keeping StarfishETL compliant.

Our breach procedures ensure we have safeguards and measures in place to identify, assess, investigate and report any personal data breach at the earliest possible time. Our robust procedures have been disseminated to all employees, making them aware of the reporting lines and steps to follow.

We perform regular company-wide information audits to identify and assess what personal information we hold, where it comes from, how and why it is processed, and if and to whom it is disclosed.

In addition to the policies and procedures mentioned above, the StarfishETL team provides easy-to-access information during the opt-in process so an individual may request any personal information that StarfishETL processes about them including:

  • The personal data held about them
  • The purposes of the processing
  • The categories of personal data concerned
  • The recipients to whom the personal data has/will be disclosed
  • How long StarfishETL intends to store the personal data
  • If StarfishETL did not collect the data directly from them, information about the source
  • The right to have incomplete or inaccurate data about them corrected or completed, and the process for requesting this
  • The right to request erasure of personal data (where applicable) or to restrict processing in accordance with data protection laws, as well as to object to any direct marketing from StarfishETL, and be informed about any automated decision-making thatis used
  • The right to lodge a complaint or seek judicial remedy, and who to contact in such instances
